What payments are paid in an injury claim under Third Party Liability?

There may be payments to you, your passenger(s), or a pedestrian or cyclist who is involved in an accident. There are two types of payments:

  • "Special damages"- These payments cover expenses like medical, ambulance, hospital or funeral bills, as well as lost wages. These are expenses that can be proven with documents.
  • "General damages"- These damages are for pain and suffering. They compensate for future disability and expenses, pain and inconvenience, reduced life expectancy and reduced or loss of capacity for future earnings. These damages are only available through lawsuits. Many provinces don't allow these lawsuits or limit them to specific situations.
